E-Cigarettes are not permitted to be taken to a place outside India or brought into India from a place outside India and Customers are not permitted to carry E-Cigarettes in their Hand Baggage or Checked-in Baggage.

India enforces one of the world’s strictest anti‑vaping regimes under the Prohibition of Electronic Cigarettes Act (PECA) 2019, which imposes a complete ban on the production, import, export, transport, sale, distribution, storage, and advertising of all e‑cigarettes, including nicotine‑free devices.

Punishment

Violations carry significant criminal penalties: first‑time offenders face up to one year in prison or fines up to ₹1 lakh, while repeat offenders can receive up to three years' imprisonment or fines up to ₹5 lakh. Even storing e-cigarettes is punishable with up to six months in jail or a fine of ₹50,000. Importantly, the law targets commercial activity rather than individuals; personal possession of a single vape is not a criminal offense, as clarified by the Ministry of Home Affairs. Enforcement remains strict due to concerns about youth addiction, flavored products, and public‑health risks.
