Mexico enforces one of the harshest vaping bans in the world, with a constitutional prohibition on all aspects of vaping—import, sale, distribution, manufacturing, advertising, and use—effective 18 January 2025, making it the first country to embed such a ban in its constitution.

Punishment

Under the 2025–2026 legal framework, penalties are severe: fines for tourists can exceed $1,000 USD for bringing in even a single device, and public use can result in fines of $50–$300 USD. Commercial violations carry up to 8 years in prison, with large‑scale trafficking punishable by up to 15 years. A 2026 reform to the General Health Law further strengthened enforcement, adding criminal penalties and fines reaching 226,000 pesos (≈$12,500 USD) for vape‑related commercial activity. Customs officers at major airports—including Cancun—actively screen, confiscate, and fine travelers carrying vaping devices, and the UK Foreign Office warns that tourists may face detention for bringing vapes into the country.
